US Court Mandates Release of Kilmar Abrego Garcia from ICE Custody
A federal judge has ordered the immediate discharge of Kilmar Abrego Garcia from immigration custody, finding his continued detainment is without lawful basis.
"Since Abrego Garcia's release after wrongful imprisonment in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis stated in her order.
The case originates in a mistaken deportation to El Salvador in March, which US authorities later acknowledged was an mistake. Following his repatriation to the United States to face human smuggling charges, he was detained in federal custody.
In her order, the court noted that the government does not have a current deportation order, which prevents them from deporting Mr. Abrego Garcia "at this juncture."
Background of the Case
The court challenge involve disputed claims. Whereas the Trump administration argues that Abrego Garcia is a affiliate of the MS-13 criminal organization, he vehemently denies this allegation.
He has also pleaded not guilty to the smuggling charges, which are part of a separate criminal case in Tennessee.
Conditions of Freedom
The court, who was hearing his challenge to deportation in a federal court, ruled that he must now comply with the conditions of his bond from jail in Tennessee. This decision effectively transfers his monitoring to the Tennessee court.
This ruling marks a significant development in a complex legal battle involving allegations of mistaken imprisonment and contested criminal associations.
